Terms of Service

Welcome to GoWith

These Terms of Service ("Terms") govern your access to and use of GoWith's platform, including our mobile application, website, and related services (collectively, the "Service"). By creating an account or using GoWith, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and Go With Social Pty Ltd (ABN: 98 687 234 635), trading as GoWith ("GoWith", "we", "us", or "our").

1. Eligibility

You must be at least 18 years old to use GoWith.

By creating an account, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms.

If we discover that you are under 18, we will immediately terminate your account and delete your information. We do not knowingly collect information from or market to minors.

2. Account Registration and Security

2.1 Creating an Account

To use GoWith, you must create an account by providing accurate, complete, and current information. You agree to:

  • Provide truthful and accurate information about yourself
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Not share your account with others
  • Notify us immediately of any unauthorized use of your account

2.2 Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain account security.

2.3 One Account Per Person

You may only maintain one account. Creating multiple accounts or using someone else's account without permission is prohibited.

3. Acceptable Use

GoWith is a platform for adults to connect over shared activities and interests. You agree to use the Service responsibly and in compliance with all applicable laws.

3.1 You May:

  • Create and join activities and events
  • Connect with other adults who share your interests
  • Share photos, messages, and information about activities
  • Build communities around shared hobbies and passions
  • Organize meetups and social gatherings

3.2 You May Not:

  • Harass or abuse others: No bullying, threats, stalking, or intimidation
  • Post illegal content: No content that violates laws or promotes illegal activity
  • Share inappropriate content: No sexually explicit material, violence, or graphic content
  • Impersonate others: No pretending to be someone you're not
  • Spam or scam: No unsolicited commercial messages, phishing, or fraudulent schemes
  • Infringe on rights: No unauthorized use of copyrights, trademarks, or personal information
  • Exploit minors: Absolutely no content or behavior related to child sexual abuse or exploitation (see our Child Safety Standards)
  • Discriminate or hate: No content promoting hatred, violence, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
  • Hack or disrupt: No attempts to compromise security, reverse engineer, or interfere with the Service
  • Scrape or automate: No automated data collection, bots, or unauthorized API access
  • Violate policies: No circumventing our rules or encouraging others to do so

4. User Content

4.1 Your Content

You retain ownership of all content you post on GoWith, including photos, messages, event descriptions, and profile information ("Your Content"). However, by posting Your Content, you grant us a license to use it.

4.2 License to GoWith

You grant GoWith a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, display, and distribute Your Content in connection with operating and improving the Service. This license ends when you delete Your Content or your account, except where Your Content has been shared with others and they have not deleted it.

4.3 Content Responsibility

You are solely responsible for Your Content. You represent and warrant that:

  • You own Your Content or have the necessary rights to post it
  • Your Content does not violate any third-party rights
  • Your Content complies with these Terms and applicable laws
  • Your Content is accurate and not misleading

4.4 Content Moderation

We reserve the right (but have no obligation) to remove, edit, or restrict access to any content that violates these Terms or that we find objectionable. We may also suspend or terminate accounts that repeatedly violate our policies.

5. Payments and Subscriptions

5.1 Paid Features

Certain features of GoWith may require payment. By purchasing these features, you agree to pay all applicable fees and charges.

5.2 Payment Processing

Payments are processed by third-party payment processors (such as Stripe). We do not store your full payment card information. You agree to provide accurate payment information and authorize us to charge your payment method.

5.3 Refunds

Refunds are handled on a case-by-case basis. Generally, payments for digital services are non-refundable unless required by law or at our sole discretion.

5.4 Event-Specific Payments

Some events may have associated fees set by event organizers. Refund policies for event fees are determined by the event organizer, not GoWith. We are not responsible for disputes between users regarding event payments.

6. Intellectual Property

6.1 GoWith's Property

The Service, including its design, features, functionality, text, graphics, logos, and code, is owned by GoWith and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

6.2 Trademarks

"GoWith", the GoWith logo, and other GoWith trademarks are the property of Go With Social Pty Ltd. You may not use our trademarks without our prior written consent.

6.3 Copyright Infringement

If you believe that content on GoWith infringes your copyright, please contact us at ben@gowith.au with details of the alleged infringement.

7. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using GoWith, you agree to our Privacy Policy.

We are committed to child safety. Our Child Safety Standards outline our zero-tolerance policy for child sexual abuse and exploitation.

8. Account Termination

8.1 Your Right to Terminate

You may delete your account at any time through the app settings or by contacting us at ben@gowith.au.

8.2 Our Right to Terminate

We may suspend or terminate your account at any time, with or without notice, if:

  • You violate these Terms or our policies
  • You engage in fraudulent, illegal, or harmful activity
  • Your account has been inactive for an extended period
  • We are required to do so by law
  • Continuing to provide the Service to you would pose a risk to us, other users, or third parties

8.3 Effect of Termination

Upon termination, your right to use the Service immediately ceases. We may delete your account and content, though some information may be retained as required by law or for legitimate business purposes. Provisions of these Terms that by their nature should survive termination will survive.

9. Disclaimers and Limitations

9.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Guarantee of Availability

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We may modify, suspend, or discontinue any part of the Service at any time without notice.

9.3 User Interactions

GoWith is not responsible for the conduct of users or the accuracy of information they provide. You are solely responsible for your interactions with other users, including attending events and meetups.

Safety Reminder:

Always exercise caution when meeting people in person. Meet in public places, tell someone where you're going, and trust your instincts. GoWith does not conduct background checks on users.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOWITH, ITS DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

In any event, our total liability to you for all claims arising out of or relating to these Terms or the Service will not exceed the greater of AUD $100 or the amount you have paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless GoWith, its directors, employees, agents, and affiliates from any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your Content

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles. You agree to submit to the non-exclusive jurisdiction of the courts located in New South Wales for resolution of any disputes.

12.2 Informal Resolution

Before filing a claim, you agree to contact us at ben@gowith.au and attempt to resolve the dispute informally. We will do the same if we have a dispute with you.

12.3 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer rights under the Australian Consumer Law or other applicable consumer protection laws that cannot be excluded, restricted, or modified by agreement.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by:

  • Posting the updated Terms with a new "Last updated" date
  • Sending you an in-app notification or email
  • Displaying a notice when you next access the Service

Your continued use of the Service after the changes take effect means you accept the updated Terms. If you do not agree to the changes, you must stop using the Service and delete your account.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and Child Safety Standards, constitute the entire agreement between you and GoWith regarding the Service.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

14.5 Third-Party Services

The Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party websites or services.
